This is what we're hearing from someone close to Mark Walton

He got cut off while driving by a woman, he flashed his lights and told her, "Hey, you need to slow down."

From there it became a little flirtatious, a roadside exchange and the girl contacted the police stating "This guy impersonated a police officer," which he never did. Then the cops showed up and they didn't include the impersonation charge on the official report - the person close to Mark feels it's an overzealous investigation.

Mark never failed the field sobriety, according the person we spoke to, but they took him in because of suspicion of DUI. He blew a .059 which will be dealt with differently, but if not for the impersonation it may not have become anything at all since it's under the adult legal limit.

Keep in mind the media was already on the scene and a crime scene van was there also, so that may be why they felt they had to charge him with something. Also keep in mind this is from the perspective of someone close to Mark.
