Decades old assault rifle ban California struck down AR-15

Judge in California struck down the decades old assault weapon ban in California yesterday. The States case evolved around the AR-15 rifle. The Judge was particularly sharp and asked to have an Ar-15 brought to him for him to study and learn about. Although scary looking the State could NOT prove how this rifle is different from any other hand gun. Meaning the AR-15 is semi-automatic requiring the person to pull the trigger each time they want 1 bullet to be shot. He basically took the approach that it's no different then any other handgun. It's not a machine gun where the shooter pulls the trigger once and bullets just keep flying out. It's no different then a shotgun, pistol, or any other legal rifle.

California has vowed to appeal.

Um, outside of firing, one trigger pull one bullet, it is much different than a shotgun and pistol.

But that's the point. The FIRING mechanism is not. Yes a different weapon but fires a bullet the exact same way. This is what the Judge based his decision on. So outside of differences in pistol and shotgun in caliber etc...the shooter is NOT holding a fully automatic weapon.

Different .. but not that much. Really not much different than a 100 year old Winchester semi auto used for hunting and target shooting. It is a rifle, a semi auto rifle, kind of like the Ruger 10-22, just available in a very broad range of calibers.

Not Breakingcane, but the difference is in the firing mechanism and the magazine capacity.

Valid points but the Judge did not think that warranted a BAN and the term assault rifle.

Not a very good analogy. A 12 gauge shotgun loaded with slugs would do a tremendous amount of damage at 30 yards .. they are used in many states for deer hunting. The Remington 750 is a semi auto 30-06 rifle .. and THAT round will do a lot more damage than a .223 (most common AR caliber).

So the bullets matter as well, not just one pull one bullet?
 
Sure, but still different in many other aspects
Fine but so is a rifle and a pistol or a 9mm and my 357 Colt Python and I think that's the point the Judge made in his decision. Many firearms are different but semi-automatic is semi-automatic, one pistol causes more damage than another so on and so forth.

Judge is 100% correct… About time a jurist grew a pair…

kudos to the Judge but even if the decision stays there is practically no where to buy ammo for it. I'm in Los Angeles and no matter where you go there are few gun for sales and the ammo shelves are empty and what is on sale is triple the costs.

Go on gunbroker.com and get your ammo. You can buy it outright in some situations or bid on lots of various calibers.
