As much as I hate it, I believe there’s case law that’s states if you’re an elected official like President Trump you cant file a lawsuit for defamation or libel. Stupid400 mill. Now Trump suing for same reason.
For Trump to prevail you have to prove actual malice, which is defined as written with total recklessness or knowledge of its falsity. It's an extreme uphill battle to prevail. BUT, once you file the suit and allege actual malice you get discovery. And that should be really interesting. There is a case, or there are some cases, which will get to the Supreme Court and give the Court a chance to over rule New York Times v. Sullivan, the case that is the authority in the field. I don't think that we should re-institute prison for defamation of a public official, but allowing plaintiffs to prevail would temper our out of control press. Here is the standard laid down by the seminal case, which so far only Westmoreland v. CBS News made it past a summary judgment. Usually in non-foreclosure cases a summary judgment will not be heard for some months in.
