California enacted its “Fair Pay to Play” act, which allows athletes to sign endorsement deals and hire agents to pursue endorsement-related income without fear of penalty. Similar bills were set to be proposed in New York, Colorado and South Carolina, among other states.
Here, in Florida, a bipartisan effort has been made in both the State House and State Senate to allow amateur athletes to profit off of their "names, images, and likeness". 4 Bills, 2 in the State House and 2 in the State Senate, have already been filed, and House Bill 251 ("HB 251") and Senate Bill 582 ("SB 582") are nearly identical. The Judiciary Committee, Commerce Committee, and Education Committee of the State House are meeting this upcoming Monday (1/9/20) at a workshop to iron out a few details, before the State Legislative Session commences shortly in Tally.
A few of my constitutional law colleagues with whom I speak believe that either HB 251 or SB 582 will pass both State Chambers, and Governor DeSantis has confirmed that he will sign into law a bill allowing amateur athletes to profit off of their "name, image, and likeness."
Such a bill would be a HUGE recruiting tool for The U, and all the other football programs in Florida. Have to imagine more states will quickly follow suit once these proverbial "dominoes" start to fall. I'm all for it, and am happy we finally starting to see some real change on this issue.
