3. Biden has pretty much only rolled back Trump which means the issue was already litigated in most instances.

Agree regarding EOs. The biggest issue is the non enforcement of existing immigration laws from Biden’s EOs. Any constitutional judge would have a field day. Maybe they are waiting through the weekend, who knows.

Judges don’t jump in and insert themselves into controversies. If you’re wanting for Trump’s judicial appointees to intervene to stop the EOs, you’ll be waiting a long time.

Judges respond to rather than initiate litigation against policies like the EOs. To my knowledge, no litigation has been filed. Trump and his AG are gone. So, the justice dept is silent. Similarly, the Republican Party is in disarray figuring out its internal fights rather than working on policy issues. They are eating each other (eg is Liz Cheney in or out?) and wondering how they’ll vote in the Senate’s impeachment trial. No time for policy.

The GOP is on its heels, leaderless and divided. Accordingly, the EOs will go forward.

And here it goes. Judge blocks Biden’s 100-day moratorium on deportations. An easy one since deportation laws are in the current legislature and need to be changed by legislators.

Immigration EO’s typically hold because they’re are in the direct interest and protection of our society. Biden’s policy though is exactly in direct conflict with protecting the population, especially with this pandemic.

Those crossing into the Us from the. Border have no way to be checked for the virus. We have enough problems , we don’t need to be allowing a free flow across the border.
