Hearing lots of talk about Stare Decisis. That Roe v Wade was Stare Decisis and therefore untouchable. But it's not an absolute.
Many of the MOST important cases in our Supreme Court OVERTURNED prior Supreme Court decisions that people thought were ABSOLUTE under Stare Decisis.
Brown v Education which ENDED SEGREGATION was a case where it overturned Plessy v Ferguson a 1896 case. No ONE ON HERE believes the 1954 Supreme Court should have fallen on the Stare Decisis Sword and left Plessy as the Law of the Land.
And there are others....................all very, very important cases.
Let me summarize todays overturning this way;
All the court said today is that the court in 1973 DISRUPTED a POLITICAL process over abortion and should NOT HAVE.
It disrupted Congress and States from making LAWS to deal with a PRESSING matter of the citizens, a womans right to choose to keep her baby or abort it.
The Supreme Court in 1973 was 6 CONSERVATIVE APPOINTED Judges 4 of whom by Nixon.
This same court dealt with segregation issues as well.
But on abortion you could hardly call it a conservative move because times were different then.
Todays court has basically said ; If you want abortion and your voters want abortion, then pass laws in your state that allow for that.
Don't come and expect the court to do your job for you.
And States will.
And heads will roll.
And some people will get voted out.
And some in.
And that is Democracy.
