It is critical because census numbers are used to determine representation in the house.

For example, if it is determined that half of the state of California is illegal, they would be entitled to half the representation they currently have.

My point was more general though about how some judges on the right and left overturn precedent and use the tool of interpertation as a device to get them to a bias or personal end result in certain cases.

As I understand it, Roberts just kicked it back to the Census people who are going to follow up with and more detailed explanation as to why the question needs to be asked. It will pass the next time.
